Why we deliberately don't pay referrers
Cash-based DTC telehealth still touches state and federal healthcare law. State fee-splitting statutes (e.g., Mass. Gen. Laws ch. 175H § 3; Cal. Bus. & Prof. Code § 650; Tex. Occ. Code § 102.001; Fla. Stat. § 817.505) restrict compensation for referrals, even for cash-pay services. Providing zero financial consideration to referrers puts our program cleanly outside those statutes.
If you're a physician bound by professional ethics rules (e.g., AMA Opinion 6.02) or by an employer's compliance policy, our structure typically means you have no financial conflict of interest to disclose beyond the fact that a referral relationship exists. That's the point.
- You must disclose your referral relationship to your patient if your professional-conduct rules require it (most do).
- You must not condition your care on the patient's use of Aurafil.
- You must not represent Aurafil as your own service.
- Federal healthcare program beneficiaries (Medicare, Medicaid, TRICARE) are ineligible for the Welcome Credit — we screen at signup.
